Terms of Service

1.1.    Welcome to Cushman & Wakefield Inter Israel Website at:

www.cw-inter-israel.com (hereinafter: the “Website”), owned by Inter Israel (A.I.) Real Estate Consultants (Registered Partnership) (hereinafter: “Inter Israel”, known in its market name Cushman & Wakefield Inter Israel”).

1.2.    These Terms of Use (hereinafter: the “
Terms of Use”) govern the relationship between Inter Israel and any person browsing or using the Website and the information and content contained therein (hereinafter: the “User”).

1.3.    In the event of any conflict or discrepancy between the Terms of Use and the terms or provisions published in any other media means, the Terms of Use shall prevail.

1.4.    Use of the Website, the information and the content presented therein, is subject to the Terms of Use. The browsing and use of the Website will be considered as complete and unqualified consent by the User to all the terms and conditions included in the Terms of Use. It is clarified that the User does not have to agree to the provisions of Terms of Use, but if he does not agree to them, he must leave the Website and not use it or the content presented therein.

1.5.    The availability of the information and the content within the Website is not constant and sometimes even subject to the provisions of the law or agreements of Inter Israel and/or anyone acting on its behalf with third parties. Therefore, Inter Israel will be entitled, according to its sole discretion, to update and/or cancel and/or remove any specific application, service or content from the Website, from time to time, immediately and without prior notice, and the User shall have no claim and/or demand in connection with that.

1.6.    The division of the Terms of Use into sections and section titles is for convenience only and it will not be used for interpretational purposes. Everything stated in this document in the male gender – also refers to females. Everything stated in this document in a singular form – also refers to plural.

Limit of Use of the Website

Without derogating from the aforesaid, Inter Israel will be entitled to prevent Users from making any use of the Website in each of the following cases:

2.1.    The User has committed an illegal act and/or has violated the law;

2.2.    The User has breached any of the Terms of Use hereinabove and hereinafter;

2.3.    The User has committed an act or omission which may harm Inter Israel and/or anyone on its behalf and/or on any third party, including other Users of the Website or the proper operations of the Website.

 

Privacy Policy

The information provided by the User in the framework of using the Website or collected by Inter Israel following such use of the Website, and any other data produced based on the analysis of this information and any information about the User that has reached and/or that will come to the attention of Inter Israel in the framework of using the Website, will be subject to the privacy statement of Inter Israel, which can be viewed here.

Intellectual Property

4.1.    All of the intellectual property rights (of any kind), including all trademarks, copyrights, rights in designs, whether registered or not, in the Website and in the contents contained therein and in any part of the Website, including in texts, in images, in graphics, in design, in the selection and arrangement of materials, in the logo, and in any software, application, computer code, graphic file and any other material contained on the Website, whether on the external interface, source code or destination code, are owned by Inter Israel only and/or serve it by virtue of licenses. All the rights in the said content are fully reserved.

4.2.    Users are prohibited from making changes, copying, storing in any means of storage, publishing, distributing, transmitting, broadcasting, displaying, performing, reproducing, making available to the public, issuing a license, creating derivative works, performing reverse engineering, or partially or fulling selling, temporary or permanent, in any form, any part of the Website, including the information and the content contained therein, without the prior written consent of Inter Israel.

4.3.    The Users are prohibited from making any commercial use of any of the Website content. Any use that goes beyond viewing the content requires the prior written consent of Inter Israel.

Liability Limit


5.1.    The Website services and data contained therein are offered as they are (“as is”), without Inter Israel being responsible or liable for them except according to law. No decision shall be made, and no transaction shall be performed or any other action relying on the information that appears on the Website and in the framework of its services. Any action that relies on the data and information that appears on the Website, is made under the sole responsibility of the User.

5.2.    Without derogating from the provisions in these Terms of Use, in no case and under no circumstances will Inter Israel and/or any of the companies related to it and/or anyone on their behalf be responsible or liable for any of the following:

 

5.2.1.    For any indirect, consequential or circumstantial expense, loss or damage (including financial loss, loss of profits, loss of a business opportunity, loss of reputation, loss of value, etc.) caused to any User or to any third party in connection with use of the Website and/or in connection to the content that appears therein;

5.2.2.    For any malfunction and/or delay and/or disruption of use of the Website (including and without prejudice to the generality of the aforesaid, in communication lines and/or the internet system and/or in cellular networks), and for any expense, loss or damage caused for any reason, including without derogating, as a result of an order and/or regulation and/or instruction of a government authority, material paralysis of communications system, earthquake, storm, shortage of materials and/or public services and/or transport services, fire, flood, explosion, accident, epidemic, strikes, slowdowns, riots, violation of public order, war, terror and/or hostility and closure. For the avoidance of doubt and without prejudice to the generality of the aforesaid, it is clarified that the User shall have no claim or right whatsoever in connection with any actions taken by Inter-Israel due to such malfunction and/or disruption;

5.2.3.    For any expense, loss or damage caused in connection with acts or omissions of the User and/or third parties, including, without derogating, telecommunications providers (including in connection to a malfunction and/or disruption, temporary or permanent, in the communication lines);

5.2.4.    For any expense, loss or damage caused to the User as a result of an update and/or cancellation and/or removing content from the Website and/or removing the Website (or blocking access to it).

 

5.3.    Without derogating from the aforesaid, Inter Israel's liability in connection with these Terms of Use, or in connection with any use of the Website, shall not exceed a total of NIS 1,000, except in cases where the provisions of the law do not permit this restriction.

5.4.    Without derogating from the aforesaid:
 

5.4.1.    It is possible that in the framework of the use of the Website, Inter Israel may provide links and references to various sites and pages on the internet operated by third parties (hereinafter: “Linked Sites”). It is possible that the User will be asked on the Linked Sites to register to these sites and pages individually, to provide various details, etc. It is agreed that Inter Israel does not have any knowledge, control, responsibility or liability for what is done on the Linked Sites and that it makes no representation regarding them whatsoever. The provision of details and registration to the Linked Sites is not subject to the Terms of Use or the privacy policy of the Website and does not relate to Inter Israel, rather solely to the Terms of Use and privacy policy of the Linked Sites and the provisions of any law. Browsing in the Linked Sites, as well as any other actions the User may perform in connection to them, is under the sole responsibility of the User. The User shall not have any claim and/or demand and/or lawsuit against Inter Israel and/or any person on its behalf and/or any related party for any direct and/or indirect loss or damage resulting from reliance and/or use of the content and/or the information provided on the Linked Sites and/or taking action by virtue of them, and it hereby waives conclusively, completely and absolutely, any such claim and/or demand and/or lawsuit as stated.

5.4.2.    The Website may contain from time to time inaccuracies or typographical errors and other errors since there is not possibility of preventing errors, flaws and mistakes in content and/or in the way it is transmitted. The User shall have no claim and/or demand in connection therewith towards Inter Israel and/or anyone on its behalf.

5.4.3.    Communication networks, computers, servers and internet sites are exposed to attacks and site hacking attempts by various parties. Inter Israel implements a number of security measures in order to maintain the privacy of the information entered in the framework of using the Website, however the User must know that it is not possible to completely guarantee this and there may be security hacks and intrusions into the site. Inter Israel does not guarantee that the site will be completely immune against unauthorized access to information. By browsing the Website and providing information of the User, the User releases Inter Israel and/or anyone on its behalf and/or related party from any liability and also from liability for any damage caused to him and/or to anyone on his behalf due to attacks, hacking attempts and intrusion into such information and he waives any claim and/or demand and/or lawsuit against them in connection to this.

Miscellaneous

6.1.    Inter Israel reserves the right to add, modify, derogate and replace the provisions of the Terms of Use, in whole or in part, at any time, according to its sole discretion, and without the prior consent of the Users, through a notice posted on the Website. The mandatory version of the Terms of Use are those that will appear on the Website from time to time. It is the User's responsibility to keep up to date with changes that have occurred, if any, in the Terms of Use. The continued use of the Website after making such a change will constitute evidence of the User's approval that he has accepted the changes. The User is advised to review the Terms of Use each time when entering the Website in order to review any changes that have occurred (if any) to the Terms of Use.

6.2.    Any disputes, claims and lawsuits in connection with the Website, including, but not limited to, the information and content contained therein, will be heard only according to the laws of the State of Israel. The competent courts of the City of Tel Aviv-Jaffa shall have exclusive jurisdiction for any matter concerning the Terms of Use and use of the Website is in, and the jurisdiction of any other court or tribunal is expressly denied.

6.3.    If a provision of the Terms of Use shall be determined by the competent court to be illegal and/or invalid, then this will not cancel the other provisions of the Terms of Use and/or the rest of that same provision that was canceled and/or reduced by the court, which was not canceled or reduced.

6.4.    Any delay by Inter Israel in exercising its right or not insisting on a right due to it according to the Terms of Use or according to law shall not serve or deemed to be a waiver by Inter Israel of such a right.
